ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY

Mansfield Speedway

By purchasing, accepting, or using a ticket, credential, or any form of admission to Mansfield Speedway (the “Facility”), and by entering the Facility, you (the “Attendee”) acknowledge and agree to the following:

1. Assumption of Risk

Motorsports, dirt track racing, and related activities are inherently dangerous. Attendee fully understands and voluntarily assumes all risks associated with attendance, including but not limited to:

•  Flying dirt, mud, rocks, debris, parts, or other objects from race vehicles or the track surface

•  Collisions, crashes, spin-outs, or loss of control by race vehicles

•  Contact with race vehicles, equipment, barriers, fencing, or other spectators

•  Uneven, slippery, or deteriorating track and facility surfaces

•  Weather conditions, including rain, lightning, extreme heat or cold

•  Acts or omissions of other attendees, participants, officials, or third parties

•  Any other risks, whether known or unknown, foreseeable or unforeseeable

2. Release and Waiver

Attendee, on behalf of themselves and their heirs, executors, administrators, successors, and assigns, hereby fully and forever releases, waives, discharges, and covenants not to sue Mansfield Speedway, its owners, operators, officers, directors, employees, agents, sponsors, sanctioning bodies, track officials, and all related entities (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, injuries (including death), or losses of any kind arising out of or related to attendance at the Facility or any event, whether caused by the negligence of the Released Parties or otherwise.

3. Indemnification

Attendee agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to Attendee’s presence at the Facility or any breach of this agreement.

4. Minors

If Attendee is under 18 years of age, a parent or legal guardian must sign this agreement (or accept it on the minor’s behalf when purchasing tickets). The parent/guardian agrees to the above terms on behalf of the minor and further agrees to indemnify the Released Parties for any claims brought by or on behalf of the minor.

5. Binding Effect

This agreement is binding upon Attendee and shall remain in full force and effect for all events and visits to the Facility. Acceptance of a ticket, scanning of a ticket, or entry into the Facility constitutes full acceptance of these terms.

6. Severability & Governing Law

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by the laws of the State of Ohio.

BY ENTERING MANSFIELD SPEEDWAY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THIS ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY.
